1. Terms & Conditions of Sale

The following terms apply to all purchases made on our website.

1. Definitions
1.1 "Buyer" refers to the individual or organization purchasing goods from the seller.
1.2 "Consumer" refers to the definition in Section 12 of the Unfair Contract Terms Act 1977.
1.3 "Contract" is the agreement between the Seller and Buyer for the sale of goods.
1.4 "Goods" refer to the products the Buyer agrees to purchase.
1.5 "Seller" refers to Boo Chi Kombucha, 22 Colwyn Court, Asheldon Road, Devon TQ1 2QT, the owner of www.boochi.co.uk.
1.6 "Website" refers to www.boochi.co.uk.

2. Conditions

2.1 These terms do not affect the Buyer’s statutory rights as a Consumer.
2.2 These terms apply to all contracts for the sale of Goods and override any communication from the Buyer.
2.3 Acceptance of delivery signifies acceptance of these terms.
2.4 Variations to these terms must be in writing and agreed by the Seller.
2.5 Complaints should be directed to the Seller at the address in clause 1.5.

3. Ordering

3.1 Orders are deemed an offer to purchase Goods and are subject to acceptance.
3.2 If Goods are unavailable, the Buyer will be informed and can choose to wait or cancel for a refund within 28 days.

4. Price & Payment

4.1 Prices are as listed on the website and include VAT where applicable. Delivery charges are extra.
4.2 Total costs will be displayed prior to payment.
4.3 After the order is confirmed, the Seller will send an email with the order details, price, and right to cancel information.
4.4 Payment must be made in full before dispatch.

5. Rights of the Seller

5.1 Prices may be updated periodically.
5.2 The Seller reserves the right to withdraw Goods from the Website at any time.
5.3 The Seller is not liable for withdrawing Goods or refusing an order.

6. Age of Consent

6.1 The Buyer may be required to declare they are of legal age to purchase certain Goods.
6.2 If the Buyer is found not to be of legal age, the order will be canceled immediately.

7. Delivery

7.1 UK deliveries will generally be made within 2-5 working days.
7.2 If a specific delivery date cannot be met, the Buyer will be informed and given the option to reschedule or receive a refund.
7.3 Delivery times are not guaranteed, and the Seller is not liable for any losses due to delays.
7.4 Risk in the Goods passes to the Buyer upon delivery. Title transfers after full payment is received.

8. Cancellation & Returns

8.1 Orders may be canceled prior to dispatch for a full refund within 28 days.
8.2 Goods must be inspected upon receipt, and the Seller notified within 7 days of any damage or discrepancies.
8.3 Defective or damaged Goods must be returned within 14 days for a replacement or refund (minus delivery charges).
8.4 Consumers have a right to cancel within 7 days of receipt for a refund, excluding certain products like unsealed audio/visual recordings.
8.5 Goods must be returned at the Buyer’s expense and in their original packaging within 14 days of cancellation.
8.6 If part of an order is canceled, delivery charges may be applicable if the remaining order no longer qualifies for free delivery.
8.7 Returned Goods must show the order number on the package.
8.8 The Buyer is responsible for any damage caused during the return process.

9. Limitation of Liability

9.1 The Seller’s liability for any breach is limited to the price of the Goods. The Seller is not liable for any indirect or consequential losses.
9.2 These terms do not limit the Seller’s liability for death or injury caused by negligence.

10. Waiver

10.1 Failure to enforce any of these terms does not waive the Seller’s right to enforce them in the future.

11. Force Majeure

11.1 The Seller is not liable for delays or failures caused by events beyond its control, including natural disasters, strikes, or shortages of raw materials.

12. Severance

12.1 If any part of these terms is found to be invalid or unenforceable, the rest of the terms shall remain in effect.

13. Changes to Terms & Conditions

13.1 The Seller reserves the right to amend these terms at any time, but changes will not affect existing contracts accepted under previous terms.

14. Governing Law & Jurisdiction

14.1 These Terms and Conditions are governed by English law, and any disputes will be subject to the exclusive jurisdiction of the English courts.
